Welcome to the website of the xPayrience Network (hereinafter xPayrience). By accessing the xPayrience Network website (hereinafter the “Site”) and browsing it, you agree to be bound by the terms of use set out below, as well as by the Privacy Policy, the content of the sections on Transaction Security and Legal Notices (collectively, the “Terms”), and agree to comply with them. You acknowledge that you have read and understood the Terms.

xPayrience reserves the right to modify these Terms at any time and without prior notice; the changes take effect as soon as they are posted on the Site. Please consult the Site regularly.

If you disagree with the Terms, you may not use the Site. Additionally, you may express your disagreement with the Terms by contacting the Site administrator by clicking here.

For the purposes of the Terms, the term “visitor” refers to a person who browses the Site as well as anyone who authorizes the use of their computing assets to do so.

The Terms constitute the entire agreement between a visitor and xPayrience regarding the use of the Site and its Content. The Terms replace any prior agreements between a visitor and xPayrience regarding the subject matter herein.

In the event of any discrepancy between the two (2) language versions of the Site and the Terms, the French version shall prevail. The use of the masculine form is for readability purposes and includes the feminine.

The Site is governed by the laws of Quebec and subject to their interpretation. Any dispute, conflict, or claim arising from or related to the use of this Site must be submitted to the jurisdiction of the courts of Quebec and is subject to that jurisdiction. Consequently, the courts of Quebec have exclusive jurisdiction over any suit, action, or proceeding arising from or relating to the use of this Site.

You acknowledge that you are authorized to visit, view, and retain a copy of the pages on the Site solely for personal purposes. Under no circumstances may you reproduce, download, publish, modify, or distribute the content of the Site other than to consult information related to products and services offered by xPayrience or to purchase products and services for personal use. You also agree not to create hyperlinks unless you have obtained authorization from xPayrience to do so. The content and software of the Site are the exclusive property of xPayrience and are protected by Canadian and international copyright and trademark laws.

xPayrience has designed this Site primarily for general informational purposes. While xPayrience has taken care to compile the information on the Site with due diligence and attention to its reliability at the time of presentation, some of this information may be incorrect or inaccurate. Additionally, from time to time, the information published may become outdated.

xPayrience reserves the right, at its sole discretion, to correct any errors or omissions or to update any information contained on the Site, including product and service prices and availability, without prior notice.

Furthermore, the Site adheres to certain computing, technical, graphic, and typographic standards. xPayrience cannot guarantee that the Site will operate without interruption or error, that there will be no delays, omissions, or loss of transmitted information, that no virus or other contaminating or destructive element will be transmitted, or that no damage will occur to a visitor’s computer system.

Under no circumstances shall xPayrience, its employees, directors, or representatives be held liable for any direct, indirect, incidental, exemplary, or other damages (including, but not limited to, loss of information, programs, or other data on a visitor’s information processing system or any other loss of intangible property) arising from the use of or inability to use the Site, its content, or documents available through the Site, or any information or functions of the Site or any related site, or arising from the conduct of a third party while using the Site, or from unauthorized access to the Site, whether or not xPayrience was advised of the possibility of such damages.

The Site contains hyperlinks that direct users to sites operated by third parties (hereinafter “Hyperlinks”).

The existence of a Hyperlink does not in any way constitute an endorsement by xPayrience of the linked site, its content, or any other sites connected to it, and xPayrience cannot be held responsible for their content or for any damages that may result from a Hyperlink. xPayrience cannot guarantee that these sites are free of viruses or other elements that may affect your computer systems. xPayrience provides no express or implied warranties regarding products or services offered by third parties, even if such information, products, or services are mentioned, included, or accessible from the Site or linked thereto.

xPayrience may, at any time, add, remove, or modify a Hyperlink appearing on the Site.

Anyone wishing to create a Hyperlink to the Site must obtain written consent from xPayrience and agree to comply with the conditions imposed by xPayrience. It is also prohibited to use framing, mirror sites, or similar methods without prior consent from xPayrience.

The existence of unauthorized Hyperlinks to the Site does not constitute consent or a waiver of xPayrience’s rights or remedies and does not engage its liability.

By choosing to use the Site, you agree, as a visitor, to xPayrience’s policies regarding the handling and protection of your personal information (hereinafter, the “Policy”). From the moment you access the Site, an automatic exchange of information occurs between your computer systems and xPayrience’s servers without any action required on your part. This exchange of information does not allow xPayrience to personally identify you. However, it does allow xPayrience to obtain certain information, including notably :

Information is collected, in particular, through cookies that the Site may automatically gather. These cookies are pieces of information stored by your Internet browser on your computer’s hard drive. They are used, among other things, to facilitate navigation, including remembering your language preference. The information collected is primarily used by xPayrience to measure the number of visits to the Site and its various pages, the average time visitors spend on the Site, and to generate other useful statistics, particularly to improve the Site.

xPayrience does not collect any personal information about you unless you voluntarily choose to provide it.

In order to process your reservation requests, service requests, or purchase orders, we need to know your name, email address, and the addresses to which confirmations of reservations or purchases of products or tourist services should be sent, if applicable. This allows us to process your requests and follow up on them in strict accordance with our security procedures. We also request your phone numbers so that we can contact you quickly in case of any issues related to your requests or their delivery.

The Site allows you to create a user profile to save time on your reservations or purchases and to enable us to contact you directly via email or phone, for example, to provide information that may be of interest to you. Personal information is collected for the purpose of creating your user profile (including modifying your profile settings and deleting your profile) and to facilitate the communication of relevant information and better understand our users’ profiles. You can at any time determine which information you wish to receive or refuse to receive. This information is strictly confidential and will only be used as outlined in the Policy.

We also use the information collected to improve the presentation and organization of our products and services, to inform you of changes and new services available on our Site, and to announce any special offers matching your preferences.

The information is stored on secure xPayrience servers located in Sherbrooke, Quebec, Canada. We maintain strict security measures regarding the storage and disclosure of the information you provide to prevent unauthorized access. You may access the personal information concerning you, notify xPayrience to update it, and request modification or deletion of certain information collected by xPayrience during your visit by sending an email to [email protected]. If you have a user profile, you can also view and update your personal information online after logging into your account. You may choose to close your profile at any time by contacting xPayrience customer service. After closing your profile, you will no longer be able to log in to our Site or access your personal information. However, you may create a new profile on our Site at any time.

Personal, electronic, or other information collected by xPayrience is not disclosed to anyone, except to xPayrience representatives or employees who require the information to perform functions related to the purposes outlined in this Policy. You acknowledge and agree that xPayrience is also authorized to use, disclose, or communicate personal information about you as required or permitted by law, including under court orders, in accordance with the Act respecting access to documents held by public bodies and the protection of personal information (C.Q.L.R., c. A-2.1).

Although we take reasonable security measures as required by law, no security system is completely fail-safe. You should remain vigilant in handling and disclosing your personal information and avoid transmitting personal information via unsecured email.
